Early Sunday morning I was shocked to see some crazy news that could put many of us, small business owners, in jeopardy. If you have a shop on Etsy or another e-commerce platform, you may have received an email like this …

But this email fails to mention ALOT and that’s why I’m here, to get to the bottom of BS like this. This is what you need to know about the INFORM ACT.

The Facts (so far) About The INFORM Act

1. This bill was sitting on the Senate floor for two months before we heard anything.

The above email from Etsy was sent out on May 23, 2021. Yet the bill was introduced as a bipartisan bill to the Senate on March 23, 2021. 

Also as far as I can gather, only eBay & Etsy users received a notice as of writing this.

2. This isn’t the first time this bill was introduced to the floor.

The INFORM ACT was introduced last year but never passed into law.

3. INFORM ACT will jeopardize your safety & privacy

The act was presented to catch counterfeiters & scammers who sell on platforms like Etsy and others. What the act is proposing is that if YOU make 200 sales OR $5000 in profit annually, you will have to disclose your personal information (bank info, personal address, EIN or Social Security # if you’re a sole proprietor). For the “safety” of consumers. 

The bill is being promoted as a tool to prevent organized crime rings from stealing and selling illegally obtained goods or selling counterfeit products online. These are worthy goals, but unfortunately as drafted it would require creative marketplaces like Etsy to collect, verify, and display sellers’ personal information (like your home address and phone number) on product listing pages, even though the unique handmade and vintage items on the marketplace are unlikely targets for such practices. Lawmakers have simply not considered how this bill would impact the privacy, safety, and security of Etsy sellers who work from their homes.

Regardless if you have a complaint against you or not. Your information will be exposed to ANYONE who views your online business.

What should you do NOW?

Tell your Senator that this act will jeopardize your business & personal safety! We already share enough of our information and NOW they want to make it a thing to share information with those who may not even purchase for your business! That will cause more damage in my opinion.
